Terms and Conditions
In the interest of both parties I have put together a T&C section to ensure that there is full transparency between the designer & the client. This ensures that in the unlikely event of a unexpected situation that both parties are covered. Throughout the Terms and Conditions listed I refer to the 'designer' being The Equine Design Room & the 'client' referring to yourself.

In order for us to start designing together, you must agree to the terms and conditions stated below. By accepting a quote, you are considered to have accepted these terms and conditions in full.
The Equine Design Room reserves the right to revise its Terms, Conditions and policies at any time.
Initial quotes & deposits
When the designer and client agree to work together there is a non refundable deposit required of 50% upfront to secure the design time. Once the deposit is paid, the design be scheduled in.
Please note once we have agreed a day for your design to commence you have 24 hours to place your deposit to secure your time. Otherwise the slot may be released to other clients.

Quotes are valid for 30 days after the quote is given, after this time please get in contact to discuss.

Once a deposit is made
Apon full payment of the deposit, the designer is committed to designing the client brief and the price quoted.

Should the client wish to change the original brief drastically or to add on additional services to their original quote, a new quote will be issued and agreed by both parties prior to work commencing.

If the clients circumstances change and for any reason the client decides to no longer persue working with the designer, an invoice will be issued for the time the designer has spent on the project at the designers hourly rate, unless a discussion is had and an agreement is reached by both parties. Frequently issues can be resolved with good communication and understanding from both parties involved.

When the designer has sent initial design concepts or revisions you have 7 days to reply to the designs, before the project is deemed closed and the client will be invoiced for the time the designer has spent on the project at the designers agreed rate.

Information sourcing for your project
The client agrees to supplying any information requested in a timely manor.
The client agrees that any information, fonts, text, images, graphics or illustrations that are supplied to the designer and are either a) owned by the client b) purchased by the client or c) Client has the owner permission for the content supplied.

Project deadlines
If the client has a set deadline that they require a project to be completed by, this must be discussed prior to the designer accepting the project.

The designer will work to the schedule requested. Any amendments to the agreed timeline must be discussed and agreed to by both the client and the designer.

The designer will not be held liable for any deadlines missed due to Acts of God (Natural disasters or outstanding circumstances that can't be controlled by the designer)

Payment terms
The designer will send the client an invoice either once the project is completed, or for ongoing work at an pre agreed time scale (weekly, 4 weekly or monthly) The client agrees to pay the invoice in full (minus any deposits made) with in 14 days.

Any clients invoices that go over the 14 day period will be charged at an interest rate of 5% daily.

The client understands that no projects will be released from the designer until the payment is made in full.

Authorial rights
The designer is entitled to authorial rights over any designs made for clients, meaning the designs created will be able to be used in a portfolio, advertising and as examples for other clients. The clients page may or may not be tagged on social media or referenced on the designers website when exercising authorial rights.

If there is any concern around the Authorial rights, the client must discuss this with the designer prior to starting the project & an agreement must be agreed on between both parties in writing.

Errors & Omissions
It is the clients responsibility to check the designs for spelling mistakes, errors and any changed required.
Once the project has been approved by the client, the designer will not be held accountable for any errors or omissions made.

Should the client notice any errors or omissions after the 7 day approval period, the client is welcome to discuss these with a designer. but please be aware this might come the additional fees.
Ongoing projects
For ongoing projects the client must agree to providing the designer with the relevant information about services or products, high quality photos and the design brief for each graphic 24 hours prior to the graphic being posted or released. This allows for time for the creation of the graphic, proof reading and amendments to be made.

The client agrees that for ongoing project, 2 weeks notice must be given to the designer in writing in the case of terminating an agreement, or amending an agreement unless otherwise agreed.

In the circumstance that a client wishes to terminate an agreement with immediate effect, the client will be invoiced for the work the designer has provided & for the hours due in 2 weeks notice period.
Revisions for projects
The designer offers upto to a maximum 5 minor revisions on any set price project (non applicable to hourly projects) and the client accepts any further revisions beyond 5 will incur an additional fee.

In the circumstance that further revisions are required, the designer will discuss with the client the additional fees involved & both parties will come to an agreement before work continues.
Commercial designs
In the circumstance that the client requests a design for the intentions of redistributing and selling the design, this must be made clear to the designer prior to the quote being given. This is not relevant to clients wishing to use their designs on workwear for employees.

Should the designer have completed a project on behalf of a client which was initially intended for personal use and the client now wishes to use for commercial purposes, the client must contact the designer in advance of the design being released for commercial purposes.

Designers discretion
The designer reserves the rights to choose what clients they work with.
​
The designer refuses to work on any project that includes:

Racist, sexist or homophobic connotations or messages.

The promotion of animal abuse
-
The promotion of deliberate misinformation​​

The promotion of anything unlawful or inappropriate

Anything that appears to be a scam or a pyramid scheme
Liability disclaimer
The designer will not be responsible for any damages the clients business may suffer through designs the client has requested.
The designer can not guarantee that all work will be error-free and so wont be liable to the client or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages.
